Terms of Service
The terms that govern your use of Puritas — what we do, what we don't, how billing works, and how disputes are resolved.
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Puritas Telehealth, LLC ("Puritas," "we," "us," or "our") governing your access to and use of puritasrx.com and the services offered through it (the "Services"). By accessing the Services, creating an account, submitting an intake, or placing an order, you accept these Terms.
Our Privacy Policy, Notice of Privacy Practices, Telehealth Informed Consent, and Shipping, Cancellation & Refunds policy are incorporated into these Terms by reference. If you do not agree to all of them, do not use the Services.
Section 21 contains a binding arbitration provision and a waiver of your right to participate in a class action. Please read it carefully.
2. What Puritas is — and what it is not
Puritas is a technology and marketing platform that connects people with independent, US-licensed clinicians and with a licensed pharmacy. We do not practice medicine, pharmacy, or nursing, and we do not provide medical advice.
- Clinical decisions are made by your provider — an independent clinician in our provider network, [Provider Network Name], exercising their own professional judgment. Providers are solely responsible for the care they deliver.
- Medications are dispensed by a licensed pharmacy — [Partner Pharmacy Name] (LegitScript-certified / NABP-accredited), which is responsible for dispensing, labeling, and shipping.
- We are not your insurer. The Services are self-pay. We do not bill insurance, Medicare, or Medicaid.
Content on the Services — articles, treatment descriptions, and FAQs — is general information, not a diagnosis, treatment recommendation, or substitute for a consultation with a qualified health professional. Never disregard or delay seeking professional medical advice because of something you read here.
3. Not for medical emergencies
The Services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. If you are in crisis or thinking about harming yourself, call or text 988 to reach the Suicide and Crisis Lifeline. Do not use the Services, email, or text messages to communicate an urgent medical need — we cannot monitor them in real time.
4. Eligibility
To use the Services, you must:
- be at least 18 years old;
- be physically located in a state where we operate at the time you submit an intake and at the time treatment is provided;
- have the legal capacity to enter into a binding contract;
- use the Services for yourself, and not on behalf of another person;
- provide accurate, current, and complete information about yourself.
Puritas is available in most U.S. states. We do not currently serve California, Louisiana, Mississippi. Availability of specific treatments varies by state. Providing a false location or false identifying information is a material breach of these Terms and may be unlawful.
5. Accounts, intake, and security
The medical intake is completed on our intake partner's platform, which is linked from the Services. Your use of that platform is governed by its own terms and privacy notice.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Use a strong, unique password, do not share it, and notify us immediately at support@puritasrx.com if you suspect unauthorized access. We may suspend an account we reasonably believe is compromised.
6. No guarantee of a prescription or of results
Completing an intake, paying a consultation fee, or placing an order does not guarantee that you will receive a prescription. A licensed provider reviews your information and decides, in their independent professional judgment, whether treatment is appropriate. The provider may decline to prescribe, may prescribe something different from what you requested, or may ask for more information or additional testing.
We make no representation that any treatment will produce a particular outcome. Individual results vary. Any results, ranges, or timelines described anywhere on the Services are illustrative and are not a promise of what you will experience.
7. Prescription and compounded medications
Prescription products are dispensed only against a valid prescription issued by a licensed provider after a legitimate patient–provider relationship is established. Prescriptions are not transferable, and you may not resell, share, or redistribute any medication dispensed to you.
Compounded medications. Some treatments offered through the Services are compounded — prepared by a compounding pharmacy for an individual patient. Compounded medications are not FDA-approved and are not reviewed by the FDA for safety, efficacy, or manufacturing quality. They are not generic equivalents of, or therapeutically equivalent to, any brand-name product, and we make no claim of equivalence. Controlled substances. We do not offer, and providers using the Services do not prescribe, controlled substances through the Services.
Safety. Take medication only as directed by your provider and as described on the label. Report side effects to your provider, to us at safety@puritasrx.com, and to the FDA MedWatch program at fda.gov/medwatch.
8. Pricing, taxes, and terms of sale
Prices are shown in US dollars and are exclusive of applicable taxes and any shipping charges, which are displayed before you confirm. Prices, product availability, and promotional offers may change at any time before you place an order.
We try to describe products and prices accurately, but errors happen. If a product is listed at an incorrect price or with an incorrect description, we may cancel or refuse the order — even after it has been confirmed — and will refund any amount charged. We may also limit order quantities or refuse service to anyone, for any lawful reason.
Your order is an offer to purchase. It is accepted only when the product ships, or, for prescription products, when the pharmacy accepts the prescription for fulfillment.
9. Subscriptions, automatic renewal, and cancellation
Most treatments are offered as a recurring subscription. By starting a subscription you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel.
- When you are first charged. Your payment method is saved during intake and charged only after a provider approves your treatment. If you are not approved, you are not charged for treatment.
- Renewal. Your subscription renews automatically at the interval and price shown at checkout, until you cancel. We will send a renewal reminder where required by law.
- Price changes. We will notify you before a price change takes effect and give you the opportunity to cancel.
- Cancelling. You may cancel at any time from your account or by contacting support@puritasrx.com or 1-800-000-0000. Cancellation stops future charges. It does not retroactively refund a charge already processed or a shipment already prepared.

10. Payment authorization
You represent that you are authorized to use the payment method you provide and that the information you give is accurate. Card details are entered through our payment provider's secure hosted fields; we do not store your full card number. You authorize us to charge your payment method for all amounts you incur, including recurring subscription charges, taxes, and shipping. If a charge is declined, we may retry it and may suspend fulfillment until payment succeeds.
11. Shipping, returns, and refunds
Shipping timeframes, delivery problems, cancellation, refund eligibility, and the reasons prescription medications generally cannot be returned are set out in our Shipping, Cancellation & Refunds policy, which forms part of these Terms.
12. Communications and mobile messaging terms
By creating an account or providing your contact details, you consent to receive communications from us electronically — including account, order, billing, safety, and legal notices — and you agree that electronic notices satisfy any legal requirement that a communication be in writing.
Mobile messaging program
- Consent. By providing your mobile number and opting in, you consent to receive recurring automated text messages from Puritas at that number. Consent to marketing texts is not a condition of purchase.
- Frequency and cost. Message frequency varies. Message and data rates may apply, and are charged by your mobile carrier.
- Opting out. Reply STOP to any message to stop receiving them. You will receive one confirmation message. Reply HELP for help, or contact 1-800-000-0000.
- Carriers. Wireless carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
- Your number. Notify us if your mobile number changes or is reassigned. You agree not to enter a number you are not authorized to use.
- Privacy. We do not share mobile numbers, opt-in data, or consent records with third parties or affiliates for their marketing purposes. See our Privacy Policy.
13. Acceptable use
You agree not to:
- provide false, misleading, or incomplete health information, or impersonate another person;
- obtain, attempt to obtain, or help another person obtain medication for anyone other than the patient named on the prescription;
- resell, divert, export, or redistribute any product obtained through the Services;
- access the Services from a state where we do not operate by masking or misrepresenting your location;
- scrape, crawl, harvest, or use automated means to access the Services, except for search engines obeying our robots directives;
- probe, scan, or test the vulnerability of the Services, breach security or authentication, or interfere with their operation;
- reverse engineer, decompile, or attempt to derive the source code of any part of the Services;
- upload malware, or submit content that is unlawful, defamatory, harassing, or infringing;
- use the Services for any unlawful purpose or in violation of any applicable regulation.
14. Content you submit
You retain ownership of the information and materials you submit. For content that is not protected health information — such as a review, a testimonial, or feedback — you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, and display it in connection with operating and promoting the Services. You represent that you have the right to grant that license.
Protected health information and the clinical information you submit for provider review are handled under our Notice of Privacy Practices — not under the license above.
Feedback and suggestions you send us are non-confidential, and we may use them without obligation or compensation.
15. Our intellectual property
The Services, and all text, graphics, photographs, logos, layouts, and software they contain, are owned by Puritas Telehealth, LLC or its licensors and are protected by copyright, trademark, and other laws. The Puritas name, wordmark, and logo are our trademarks. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your own personal, non-commercial purposes. All rights not expressly granted are reserved. You may not copy, modify, distribute, or create derivative works from the Services without our written permission.
16. Third-party links, products, and services
The Services link to and rely on third parties — our intake partner, provider network, partner pharmacy, payment processors, and shipping carriers. We do not control third-party websites or services and are not responsible for their content, products, policies, or practices. A link is not an endorsement. Your dealings with a third party are between you and that party.
17. Suspension and termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms, if required by law, if continuing would create a safety or clinical risk, or if we discontinue the Services.
Termination does not affect any order already accepted, any payment already due, or the provider's and pharmacy's obligation to retain your records. Sections that by their nature should survive — including 15, 18, 19, 20, 21, and 22 — survive termination.
18. Disclaimers
Except as expressly stated in these Terms and to the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that content is accurate, complete, or current. We are not responsible for the professional judgment, acts, or omissions of the independent providers who treat you or of the pharmacy that dispenses your medication.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.
19. Limitation of liability
To the fullest extent permitted by law, Puritas Telehealth, LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Services — whether based in contract, tort, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars ($100).
These limitations do not apply to liability for gross negligence, willful misconduct, or anything else that cannot be limited under applicable law, and they do not limit the liability of any provider or pharmacy for their own professional conduct. Some jurisdictions do not allow the limitation of incidental or consequential damages, so this section may not fully apply to you.
20. Indemnification
You agree to indemnify, defend, and hold harmless Puritas Telehealth, LLC and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense — including reasonable attorneys' fees — arising from your use of the Services, your breach of these Terms, your violation of any law or third-party right, or any false or incomplete information you provided. We may assume the exclusive defense of any matter subject to indemnification, at your expense, and you agree to cooperate.
21. Dispute resolution, arbitration, and class action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first
Before starting an arbitration, you agree to contact us at legal@puritasrx.com with a written description of the dispute and the relief you seek, and to give us 60 days to resolve it informally. This step is a precondition to filing.
Binding arbitration
If we cannot resolve the dispute informally, you and Puritas agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by [Arbitration Provider] under its applicable consumer rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator — not a court — decides questions of arbitrability, except as stated below.
Class action waiver
You and Puritas agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be severed and brought in court, and the rest of this section still applies.
Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the Services. Nothing here prevents you from reporting a concern to a government agency.
Your right to opt out
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@puritasrx.com with the subject line "Arbitration Opt-Out," including your name, the email address on your account, and a clear statement that you are opting out. Opting out does not affect any other part of these Terms, and we will not retaliate against you for doing so.
22. Governing law, venue, and severability
These Terms are governed by the laws of the State of [State], without regard to its conflict-of-laws rules, and by the Federal Arbitration Act as to Section 21. For any dispute not subject to arbitration, you and Puritas consent to the exclusive jurisdiction and venue of the state and federal courts located in [County, State]. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions stay in full force.
23. Copyright complaints
If you believe content on the Services infringes your copyright, send a notice under the Digital Millennium Copyright Act to legal@puritasrx.com, or to Puritas Telehealth, LLC, Attention: Copyright Agent, 000 Example Street, Suite 000, City, ST 00000. Include identification of the work, identification of the material and its location, your contact details, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your signature. We will respond as the DMCA requires and may terminate the accounts of repeat infringers.
24. General provisions
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, labor disputes, supply shortages, carrier delays, government action, and network or utility failures.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. Except for the indemnified parties named in Section 20, these Terms create no rights in anyone who is not a party to them.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Entire agreement. These Terms and the policies incorporated into them are the entire agreement between you and Puritas regarding the Services, and supersede any prior agreement on the subject.
25. Changes to these terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page, and if the change is material we will give notice — by email or a prominent notice on the site — before it takes effect. Changes do not apply retroactively to a dispute that arose before they took effect. Continuing to use the Services after a revision takes effect means you accept it.
